TERMS OF SERVICE

These Terms of Service ("Terms") are a legal agreement between you and LittleCard ("Company," "we," "us," or "our") governing your use of the littlecard personal product, including the website, the web-based dashboard, personal bio pages (the "Site"), and the purchase of physical NFC-based business cards (collectively, the "Service").

BY CREATING AN ACCOUNT OR PURCHASING A PRODUCT, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU ARE AGREEING TO THESE TERMS ON BEHALF OF AN ENTITY, YOU REPRESENT THAT YOU HAVE THE AUTHORITY TO BIND THAT ENTITY.

  1. THE SERVICE

1.1. Description: littlecard personal provides a digital bio-page hosting service and physical NFC-enabled cards that facilitate data transfer via tap-to-redirect functionality. 1.2. Modifications: We reserve the right to modify or discontinue features of the dashboard or bio-page templates at any time.

  1. ACCOUNTS AND ELIGIBILITY

2.1. Registration: You must provide accurate and complete information. You are responsible for all activities under your account. 2.2. Global Access: While we ship globally, you are responsible for ensuring your use of the Service complies with local laws in your jurisdiction.

  1. PURCHASES AND SUBSCRIPTIONS

3.1. One-Time Purchases: Users may purchase physical cards for a one-time fee. These cards include basic redirect functionality as defined at the time of purchase. 3.2. Subscriptions: Enhanced features (e.g., advanced dashboard analytics, premium templates) are available via a recurring subscription ("Subscription"). 3.3. Billing: Subscriptions are billed in advance. All prices are exclusive of VAT or local sales tax unless stated otherwise. 3.4. Cancellation: You may cancel your Subscription at any time through the dashboard. Upon cancellation, you will retain access to premium features until the end of your current billing period.

  1. PHYSICAL GOODS AND SHIPPING

4.1. Global Shipping: We ship physical cards globally. You are responsible for any import duties, taxes, or customs fees imposed by your country. 4.2. Templates and Design: Physical cards are created based on limited templates. You acknowledge that colors and textures on physical cards may vary slightly from digital previews. 4.3. Shipping Risk: Risk of loss and title for physical items pass to you upon our delivery to the carrier.

  1. REFUND AND CHARGEBACK POLICY

5.1. Digital Services: Subscription fees are non-refundable for the current billing period. We do not provide pro-rated refunds for partial months of service. 5.2. Custom Physical Goods: Because physical cards are custom-manufactured based on your configuration, all sales are final. Refunds are only issued if the NFC chip is non-functional upon arrival. 5.3. Hardware Recovery Fee: If a physical card was provided as part of a promotional subscription bundle and the subscription is canceled or disputed before a minimum period (as defined at checkout), LittleCard reserves the right to charge a one-time fee to cover the cost of the physical hardware already shipped.

  1. USER CONTENT AND CONDUCT

6.1. License: You grant LittleCard a non-exclusive, worldwide license to host and display the content you upload to your bio page. 6.2. Prohibited Content: You may not use the Service to host or link to:

Malware, phishing, or scam sites.

Hate speech, pornography, or illegal substances.

Infringing intellectual property. 6.3. Right to Terminate: We reserve the right to disable any bio page or redirect link that violates these Terms without a refund.

  1. DISCLAIMER OF WARRANTIES

THE SERVICE AND PHYSICAL CARDS ARE PROVIDED "AS IS." TO THE EXTENT PERMITTED BY LAW, LITTLE CARD DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE NFC TECHNOLOGY WILL BE COMPATIBLE WITH ALL SMARTPHONE MODELS.

  1. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LITTLE CARD SHALL NOT BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, OR INCIDENTAL DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO LITTLE CARD IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

  1. GOVERNING LAW AND DISPUTE RESOLUTION

9.1. Governing Law: These Terms are governed by the laws of the State of Missouri, USA, without regard to conflict of law principles. 9.2. EU Consumers: If you are a consumer residing in the European Union, you may benefit from mandatory provisions of the law of the country in which you are resident. 9.3. Arbitration: Any disputes shall be resolved through binding arbitration in St. Louis, Missouri, except that you may assert claims in small claims court if your claims qualify.
